About this tender
The Gorlice city authority (Miasto Gorlice) is procuring refuse collection services in Gorlice. The scope covers collecting and processing municipal waste, organising a PSZOK (Punkt Selektywnej Zbiórki Odpadów Komunalnych, a municipal selective waste collection point), and providing waste acceptance and processing services at that point. The procedure is an open tender (przetarg nieograniczony) for a classical contract above EU thresholds, conducted under the Polish Public Procurement Law (Pzp, Dz.U.2026 poz. 793, as amended). The buyer will first evaluate and compare the bids, then conduct subject-matter qualification of the highest-ranked bidder, checking the absence of exclusion grounds and fulfilment of participation conditions. The contract period runs from the signing date, but not earlier than 1 January 2027, until 31 December 2027. The contractor must start operating the PSZOK no later than 90 days after contract signature, and not earlier than 1 January 2027. The contract template (Annex 2 to the SWZ) sets out the essential contract terms. Variant bids are not permitted, no foreign-currency settlement is provided for, and the buyer does not reserve any part of the contract for personal performance by the contractor.
Bidder eligibility
Bidders must not be subject to exclusion grounds under Article 5k of Council Regulation (EU) No 833/2014 and Article 7(1) of the Polish act on special measures countering support for aggression against Ukraine. Each bidder must submit a declaration of non-exclusion and fulfilment of participation conditions via the ESPD (JEDZ, Annex 4 to the SWZ). In the JEDZ, bidders may complete only Section α of Part IV, with full evidential verification done later for the top-ranked bidder on request. Joint bidders must each submit the declarations. Where a bidder relies on the capacity of other entities, it must submit their JEDZ, a commitment or other evidence that the resources will be available, and the declarations on exclusion grounds. Where applicable, bidders must also provide a power of attorney for signatories, a guarantee or bank surety for the bid bond, and information under Article 225(2) Pzp. The specific technical and professional participation conditions are set out in the SWZ, which is not included in the excerpt provided.
