Solucions Integrals per als Residus, S.A.U. (TERSA) is procuring the treatment of earth and rubble (terres i runes) collected at the civic amenity sites (deixalleries) serving the Àrea Metropolitana de Barcelona (AMB). The contract is classified as a services contract under CPV 90513000-6 (non-hazardous refuse and waste treatment and disposal services), with execution in Barcelona (ES511). The contract is a harmonised, open procedure under ordinary processing, with unit prices and no price revision. The file justifies this under Art. 99.3.b) of the Spanish public procurement law, on the grounds that splitting the services would hinder technical coordination and create implementation risk. Special execution conditions apply. The contractor must maintain the labour and social conditions of the workers engaged in performing the contract, as set under the applicable collective agreement at the time of the offer. The contractor, its subcontractors and affiliated companies may not carry out financial operations in tax havens or in criminal contexts such as money laundering or tax fraud, under a 2016 municipal decree. Bidders must submit offers electronically via licitacions.bcn.cat, and the offers must be drafted in Catalan, Spanish, English or Aranese. The tender documentation includes the PCP, the technical prescriptions (PPT), the justification report, the DEUC and annexes.

Bidder eligibility

Economic and financial standing: (1) annual business volume of at least €750,000.00, evidenced by annual accounts; (2) net worth or equity-to-liabilities ratio above 2/3 of share capital, evidenced by annual accounts. Technical and professional capacity: a responsible declaration listing at least 3 waste-management services performed in the last three years, with a cumulative annual amount of at least €500,000.00, evidenced by certificates or declarations of good quality. Bidders must also comply with the special social execution conditions (maintenance of labour conditions and the tax-haven/criminal financial operations prohibition). Standard submission documents include the DEUC.

How bids are scored

Automatic evaluation criteria total 100 points, split as follows: Price, 50 points; other automatic criteria, 50 points, comprising Proximity (25 points) and Waste treatment (25 points). There are no criteria subject to value judgment (0 points). The price/quality split is therefore 50/50 on automatic criteria, with no subjective scoring.
